Yes — Evidence Act §78A makes electronic records admissible, and notaries on our platform are LSK-licensed appointees of the Chief Justice operating within Notaries Public Act Cap 17. The cryptographic seal + video recording + audit trail satisfy the "qualified electronic signature" bar under KICA 2009 §83C. We've pre-tested with a small panel of senior advocates and litigators; expect minor judicial education in the first 2 years as judges encounter their first notarized e-bundle.
For documents going overseas you may want apostille certification on top — which we're partnering with the Ministry of Foreign Affairs to streamline. International audiences expecting Adobe's "green check" cryptographic trust mark will get it via our AATL-rooted certificate option (premium tier). The base bundle works for all in-Kenya use cases.
The notary's act is the same — they verify your identity, witness your signature, apply their seal. The difference is the medium: video instead of physical, cryptographic seal instead of ink-and-stamp. Both are legally equivalent under Business Laws Amendment Act 2020 §83A-H. The tamper-evidence is actually stronger than physical notarisation, where forged seals are surprisingly common.
Wills require additional witnesses under the Law of Succession Act §11 — typically two non-beneficiary witnesses. Our wills tier handles this: the notary co-ordinates both witnesses in the same video session. Retention extended to lifetime + 12 years per probate window practice.
Documents and recordings are stored in Kenya in DPA-2019-compliant infrastructure. Only you, your notary, and Xcobean operations (audit only) can access them. Recordings encrypted at rest. You can request deletion at any time subject to ongoing legal holds. Full DPA SAR/erasure rights honoured within 7 days of request.
48-hour dispute window from session end. Escrow is held — the notary doesn't get paid until the dispute window closes clean. If you raise a complaint, we freeze the bundle, refund you, and route to the LSK Disciplinary Committee if conduct merits. Notaries with sustained complaints are removed from the platform.
Current LSK practising certificate, KRA PIN, National ID, a basic webcam, and a quiet room. We verify against the LSK roll automatically. After approval (24-48 hours) we issue you a per-user signing certificate via our internal CA — no separate hardware token needed at MVP. Onboarding is online, takes about 20 minutes.
